TERMS & CONDITIONS

These terms and conditions...

  1. ...represent the entire agreement between the parties and no alterations or additions may be effected unless agreed to by both parties, reduced to writing and signed by the customer of Advance Fitness (hereinafter referred to as “the Customer”) and a duly authorised representative of Advance Fitness (hereinafter referred to as “the Company”);

  2. ...are final and binding and are not subject to a suspensive or dissolutive condition.

Disclaimer

Before using any equipment and/or gear available on this website please consult a physician. Improper use can result in injuries. The Company is not responsible for any injury, whether sustained through correct or incorrect use, which may occur through the use of any equipment and/or gear purchased from the Company or any of its consignees, distributors or retailers.

Pricing

If any product reflects an incorrect price or incorrect information due to typographical error, we reserve the right to refuse or cancel any orders placed for that product. Price and specifications are subject to change without prior notice. Prices are all in South African Rands and do not require VAT as per legislation.

Cancellation

In the event of an order being refused or cancelled which has been paid for, we will issue a refund for the full amount using the same method of payment. This cancellation period will last 48 hours from time of order placement.

Terms of sale

All orders are subject to availability and confirmation of the order price.

The final purchase will not be completed until the Customer’s payment has been cleared in the Company’s account and approved by the Company. Orders not paid in full and reflecting in the Company’s bank account in 7 business days of order placement will be cancelled without notice to the Customer.

Once an order is placed, all details are considered final. The Customer takes full responsibility of checking that all orders and delivery address/es are correct (these can’t be changed after the order is approved and dispatched).

If the delivery address details the Customer provides is incorrect and the Customer needs the order redirected, the Customer will be subject to additional charges with a revised amount.

Sales, Specials, Free Delivery

All specials are only valid while stocks last and are based on a first-come-first-served basis. All sales/specials shall not apply to bulk orders of 10 products or more. The sale discount shall apply per product. Free deliveries apply only to destinations within South Africa – destinations outside South Africa shall be subject to the applicable courier costs and available on request.

Stock

Although this website is linked to the Company’s stock system, occasionally an item of stock that the Customer purchases may not be available. In this instance, the Customer will be given the choice to purchase an available product to the same value, wait for the desired product to be in stock or a full refund on that item.

Delivery

Orders are released for dispatch only upon receipt of a cleared payment in full, unless otherwise arranged.

If one or more items on an order is backordered, the whole order will be dispatched when all those items are in stock. If the Customer would like the order shipped in separate batches (based on availability) then the Customer will incur the separate courier charges per batch.

The Company will endeavour to meet delivery turnaround times of 2-5 business days for “Economy” shipping and 24-48 business hours for “Express” shipping. Deliveries are not made on public holidays and weekends unless explicitly requested and the additional surcharges are paid in full in advance. "Express" orders placed after 15:00 on Fridays and on the weekends will be delivered in 24-48 business hours from the next Monday if that Monday is not a public holiday. The Company will endeavour to meet the delivery of up to 5-14 working days for international orders with destinations outside of South Africa. To the extent allowed by law, the Company shall not be liable for any loss or damage, of whatsoever nature, which the Customer may suffer as a result of any incorrect or delayed delivery or tampering of goods, unless the aforesaid has regard to circumstances within its reasonable control.

Warranty

The Company warrants that the goods which have been supplied by the Company and delivered to the Customer shall be free from defects and subject to the following:

  1. The warranty is effective for ninety (90) days and the Customer shall be entitled to either request a refund or replacement of goods if goods are defective within such period.

  2. The warranty shall immediately be rendered null and void in the event of any of the following:

    1. Failure to use the goods in a reasonable manner for the functions they are intended including exercising/performing using bars, barbells, dumbbells, kettlebells, ropes and approved exercise machines that are in good repair,

    2. If the goods have been subjected to alteration, neglect or tampering,

    3. The goods are not accompanied by original Invoice.

Returns

A Client may return goods purchased directly from Advance Fitness in the following instances:

  1. within thirty (30) days of date of the receipt of the goods, but the Customer will be responsible for applicable shipping; or

  2. within the warranty period if the goods are defective; or

  3. within 10 business days, if the Company has made an error in delivery.

Privacy

POPI (Protection of Personal Information)

We respect your right to privacy and therefore aim to ensure that we comply with the legal requirement of the POPI Act which regulates the manner in which we collect, process, store, share and destroy any personal information which you have provided to us.

Why we collect Personal Information

We collect personal information in order to liaise with you telephonically, via our website, email or via social media such as Facebook so that we may:

  1. respond to any query or comment received from you;

  2. inform you of new products;

  3. enable us to process, validate and verify information and requests for the supply of goods;

  4. for the purposes for which you specifically provided the information; and

  5. generally to improve your experience on our website.

 

Minors

If you are under 18 years of age (minor), we will require the consent of your parent/guardian/competent person before we process such personal information.

Processing of Information

We will share your personal information:

  1. in order to comply with applicable law or with legal process served on our company;

  2. in order to protect and defend the rights or property of our company; and

  3. with employees and/or third parties who assist us in providing products to you and thus require your personal information in order to render a proper and efficient service. We will ensure that all such employees and third party service providers, having access to your personal information, are bound by confidentiality agreements.

 

Your rights

You have the right at any time to:

  1. rectify the Personal Information collected by us;

  2. object to the processing of Personal Information (subject to legislation);

  3. request the return or destruction of Personal Information (subject to legislation);

  4. lodge a complaint with the Company.
